Terms of Use & License Agreement

1. Agreement

By creating an account or using SecretMemos, you agree to these Terms of Use and License Agreement. If you do not agree, do not use the service.

2. Service Description

SecretMemos is a personal information manager for storing memo entries (for example account names, emails, URLs, and encrypted password/note fields), structured notes, and note pages.

The service uses account login and an authenticated cookie session to provide access to your data in the application.

3. Data We Collect

  • Account data: name, email, password hash, salt, account status, settings, and account timestamps.
  • Content data you create: memos, notes, pages, categories, URLs, and related metadata.
  • Security and session data: authentication cookie token metadata (including token expiry and IP check against request IP), and standard request metadata needed for operation and abuse protection.
  • Technical metadata for memo icons when used (icon binary data, MIME type, source URL, update timestamp).

4. Data We Do Not Intentionally Collect

  • No payment card or banking data is requested by default.
  • No government ID numbers are required by default.
  • No built-in advertising profile or third-party ad tracking is intentionally provided in the current service flow.
  • No guarantee is made that any user-provided field is free from sensitive personal data, because users control what they enter.

5. How the Program Works

  • You register with name, email, and password hash.
  • You authenticate through login; a secure cookie-based session is used for protected routes.
  • You create and manage memos, notes, and pages that are stored in the service database.
  • You can export your stored data using available export functionality.
  • Your master password and any key that can decrypt your protected data are not transferred to the server.
  • Encryption and decryption of protected data are performed on your client machine.

6. Advantages and Disadvantages

Advantages: centralized data organization, account-based access control, configurable settings, and export support.

Disadvantages / Limitations: service availability depends on infrastructure and configuration; security also depends on your password strength and endpoint/device security; no software can guarantee absolute protection from all threats.

7. License Grant and Restrictions

Subject to compliance with these Terms, you receive a limited, revocable, non-exclusive, non-transferable license to use the service for lawful personal or internal business purposes.

  • Do not reverse engineer, disrupt, overload, or abuse the service.
  • Do not attempt unauthorized access to accounts, systems, or data.
  • Do not use the service for unlawful, infringing, or malicious activity.

8. User Responsibilities

  • Provide accurate registration information and keep credentials confidential.
  • Use strong master passwords and maintain security on your own devices.
  • Keep independent backups of important information.
  • Comply with applicable law in your jurisdiction.

9. Intellectual Property

The service software, structure, and non-user content are owned by the author/service provider or licensed to them, and are protected by applicable intellectual property laws.

You retain rights to content you create, and you grant the provider a limited right to process it solely to operate, maintain, secure, and improve the service.

10. Disclaimer of Warranties

The service is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, to the fullest extent permitted by law.

11. Limitation of Liability

To the fullest extent permitted by law, the author and service provider are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profit, or business interruption arising from use of the service.

12. Indemnification

You agree to defend, indemnify, and hold harmless the author and service provider from claims, liabilities, damages, and expenses resulting from your misuse of the service, your content, or your violation of these Terms or applicable law.

13. Suspension and Termination

The provider may suspend or terminate access for security reasons, legal compliance, abuse prevention, operational reasons, or material violations of these Terms.

14. Changes to Terms

These Terms may be updated over time. Continued use after changes become effective means you accept the updated Terms.

15. Governing Law

These Terms are governed by applicable law in the provider’s jurisdiction, unless mandatory law requires otherwise.
